Child Visitation Standard Possession Schedule

Texas family code is designed to promote ongoing healthy relationships between parents and children. The Texas Family Law provides for a minimum visitation schedule that is presumed to be in the best interest of the child, which is called a “Standard Possession Schedule.”  This standard possession schedule allows the non-custodial parent the right to have significant periods of possession and access to the child. Many times the parties will resolve their child custody matter by entering into an agreement that contains a variation of a standard possession schedule or even an entirely different possession schedule that fits the needs of their child.

Occasionally, even Courts will vary from the standard possession schedule and impose their own possession schedule if such a schedule is in the child’s best interest. Some examples of a varied possession schedule may be an equal possession schedule or a 50/50 possession schedule with the child.

Additionally, it is important for parents to establish child custody and each parent’s visitation with the child in a court order, because if there is no court order regarding the child, parents have an equal right to possession of the child and one parent could withhold the child from the other parent. No parent wants to see their child as a pawn in a tug of war.
